Terms of Service

Please read these Terms of Service ("Terms") carefully before using NeverLose CRM ("the Service"), operated by NeverLose CRM ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Use of the Service
NeverLose CRM is a customer relationship management tool designed for individual salespeople and small sales teams. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to send unsolicited bulk messages in violation of applicable law
- Attempt to gain unauthorized access to any part of the Service
- Use the Service in any way that could damage, disable, or impair it
- Reproduce, duplicate, copy, or resell any part of the Service
2. Accounts
You are responsible for maintaining the security of your account and password. You are responsible for all activity that occurs under your account. You must notify us immediately at support@neverlosecrm.com if you suspect any unauthorized use of your account.
You must be at least 18 years old to use the Service. By agreeing to these Terms you represent that you are at least 18 years of age.
3. Subscriptions and Billing
Some features of the Service require a paid subscription. By selecting a paid plan, you agree to pay the applicable fees. All billing is processed securely through Stripe. We do not store your payment card information.
- Free plan: No charge. Core CRM features with usage limits.
- Pro plan: $29/month, billed monthly or annually.
- Pro Plus plan: $65/month, billed monthly or annually. Includes SMS features.
Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time through your account settings. Refunds are not provided for partial billing periods.
4. SMS Features
Pro Plus subscribers may send SMS messages through the Service via Twilio. By using SMS features you agree to:
- Obtain proper consent from recipients before sending marketing messages
- Honor all opt-out requests (STOP replies) immediately
- Comply with the TCPA, CAN-SPAM Act, and all applicable federal and state laws governing commercial messaging
- Not send messages outside the hours of 8am–9pm in the recipient's local time zone
We reserve the right to suspend SMS access for accounts that violate messaging laws or generate excessive complaints.
5. Your Data
You own the data you enter into NeverLose CRM — your contacts, jobs, notes, and files. We do not sell your data to third parties. See our Privacy Policy for full details on how we handle your information.
You may export your data at any time from your account settings (Pro and Pro Plus plans). Upon account termination, your data will be deleted from our servers within 90 days.
6. Availability
We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice.
7. Limitation of Liability
To the fullest extent permitted by law, NeverLose CRM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of or inability to use the Service.
Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Termination
We may terminate or suspend your account at our discretion if you violate these Terms. You may cancel your account at any time through account settings. Upon termination, your right to use the Service will immediately cease.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes in-app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
